contacts or other communications beyond the scope of this
transaction
Trial and Usage Terms: The
"Company" by and through its authorized agent,
who completed this form, hereby requests from Tango/04 Computing
Group, a thirty (30) day evaluation period for the Product(s)
selected. As an express condition of Tango/04 Computing
Group granting Company a non-exclusive limited license,
Company agrees that the Product(s) is a copyrighted, proprietary
product and agrees not to copy, disclose or distribute the
Product(s), in any form, to any third party, not to reverse
assemble or reverse compile the Product(s), in whole or
in part, or permit any other person to do so. Company further
agrees that use of the Product(s) is solely and exclusively
for evaluation purposes to decide whether Company wishes
to purchase the Product(s).
If Company does not enter into a Purchase License
Agreement after 30 days or does not obtain an extension
of the evaluation period from Tango/04 Computing Group or
an Authorized Tango/04 Computing Group Business Partner
for the Product(s), Company agrees to promptly delete the
Product(s) and any copies, thereof, including all associated
documentation.
The Product(s) is copyrighted to Tango/04 Computing
Group. Company may not copy, in whole or part, nor reproduce
it in any manner without the express, written permission
of TANGO/04. Licensee may not remove any copyright or other
proprietary notices contained in the software. Company may
not sell, assign, give, or otherwise transfer this Product(s)
to any third party without TANGO/04's prior written consent.
The Product(s) is provided by TANGO/04 on an
"AS IS" basis. No other warranties, either expressed
or implied, with respect to Product(s) apply. TANGO/04 shall
not be liable for any direct, indirect, incidental or consequential
damages which result from any defect in the software or
from its use. TANGO/04 warrants that to the best of its
knowledge the Product(s) does not infringe or violate any
patents, copyright, trademark or other rights of a third
party.
By completing and returning this Agreement,
you acknowledge that you have read this agreement, understand
it and agrees to be bound by its terms and conditions.
